Welcome to Sexikinis Swim.

These Terms of Service (“Terms”) govern your use of the Sexikinis Swim website, mobile application, online store, products, services and related features.

Throughout these Terms, the terms “Sexikinis Swim,” “Sexikinis,” “we,” “us,” and “our” refer to Sexikinis Swim.

By accessing our website, using our mobile app, creating an account, placing an order or otherwise using our services, you agree to these Terms, together with our Privacy Policy, Final Sale & Store Credit Policy, Shipping Policy, and any other policies referenced on our website.

If you do not agree with these Terms, please do not use our services or place an order.

1. ONLINE STORE TERMS

By using our store, you represent that you are legally permitted to enter into a binding agreement or that you have obtained any consent required by applicable law.

You may not use our products or services for any unlawful or unauthorized purpose.

You must not transmit viruses, malicious code or other harmful material through our website, mobile application or services.

We reserve the right to refuse service, restrict access or cancel transactions where reasonably necessary to protect Sexikinis Swim, our customers, our systems, or to comply with applicable law.

2. PRODUCTS & PRODUCT INFORMATION

We make reasonable efforts to display our merchandise, product descriptions, photographs, colors, sizing and other information as accurately as possible.

However, colors may appear differently depending on photography, lighting, screen settings and the device being used.

We cannot guarantee that every customer’s device will display colors exactly as they appear in person.

We reserve the right to:

• Modify product descriptions or information
• Change prices
• Discontinue products
• Limit quantities
• Restrict sales where reasonably necessary
• Correct typographical or pricing errors
• Cancel orders affected by obvious errors, subject to applicable law

Product availability is not guaranteed until an order has been successfully processed.

3. PRICES & PAYMENT

Prices displayed on our store are subject to change without notice.

The price charged for merchandise will generally be the price displayed at the time the order is successfully placed, except in circumstances involving an obvious pricing, technical or system error.

Customers are responsible for providing accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel an order where we reasonably suspect fraud, unauthorized payment activity, inaccurate information or other misuse of our services.

4. ALL SALES ARE FINAL

ALL SEXIKINIS SWIM SALES ARE FINAL.

Sexikinis Swim does not accept returns or exchanges once merchandise has been delivered, subject to any rights or remedies that cannot be excluded under applicable law.

Due to the intimate nature of swimwear, our no-return policy also protects the health, hygiene and safety of our customers.

We do not provide monetary refunds for change of mind, sizing issues, fit preferences, style preferences or other Final Sale purchases.

Where Sexikinis Swim approves an eligible customer-service claim, store credit may be provided as the resolution, subject to our published Final Sale, No Return & Store Credit Policy and applicable law.

Please review our Final Sale, No Return & Store Credit Policy before placing an order.

5. DAMAGED, DEFECTIVE, INCORRECT OR MATERIALLY NOT-AS-DESCRIBED ITEMS

If you believe that merchandise was delivered damaged, defective, incorrect or materially different from the item ordered, you must contact Sexikinis Swim within 48 hours of confirmed delivery.

You may be required to provide your order number, photographs, packaging information and other reasonable evidence necessary for us to investigate the claim.

Submitting a claim does not automatically entitle a customer to a monetary refund, store credit or replacement.

We will review eligible claims and determine the appropriate resolution in accordance with our policies and applicable law.

Customers should not return merchandise unless Sexikinis Swim specifically provides return authorization or instructions.

6. MODIFYING OR CANCELLING AN ORDER

We work to process and ship orders as quickly as possible.

For this reason, orders cannot be cancelled, modified or changed after they have been successfully placed and submitted for processing.

• Colors
• Quantities
• Billing information
• Shipping address

before completing checkout.

Sexikinis Swim is not responsible for order errors resulting from information incorrectly entered or selections incorrectly made by the customer.

7. SHIPPING & DELIVERY

Customers are responsible for providing a complete and accurate shipping address when placing an order.

Once an order has been transferred to the applicable shipping carrier, delivery times may be affected by circumstances outside Sexikinis Swim’s reasonable control.

Estimated delivery dates are estimates and are not guarantees.

Customers should refer to our Shipping Policy for additional information regarding processing, shipping, delivery and related procedures.

8. RETURN TO SENDER & UNDELIVERABLE PACKAGES

If a package is returned to Sexikinis Swim because of:

• An incorrect or incomplete address provided by the customer
• An undeliverable address
• Failure to collect or accept the package
• Refusal of delivery
• Another customer-related delivery issue

Sexikinis Swim may issue store credit for the eligible merchandise amount actually paid, excluding original shipping charges and other non-refundable delivery-related costs, once the returned package has been received and processed.

Original shipping charges are not eligible for store credit in these circumstances.

If the customer wishes to have the merchandise shipped again, additional shipping charges may apply.

9. LOST, STOLEN OR DELAYED PACKAGES

Sexikinis Swim is not responsible for carrier delays or circumstances outside our reasonable control.

If tracking indicates that a package has been delivered but you cannot locate it, please contact the applicable shipping carrier and notify Sexikinis Swim so that available options can be reviewed.

Any resolution will depend on the circumstances of the shipment, carrier investigation and applicable law.

10. PROMOTIONS, DISCOUNTS & COUPON CODES

Sexikinis Swim may periodically offer promotional discounts, sales, coupon codes or other special offers.

Unless otherwise stated:

• Promotions cannot be combined.
• Promotional discounts cannot be applied retroactively to previously completed purchases.
• Price adjustments are not provided on previous orders.
• Promotional codes must be entered correctly before checkout is completed.
• Promotions have no cash value.
• Promotions may be subject to product, quantity, customer, geographic or time restrictions.

Sexikinis Swim reserves the right to modify, suspend or cancel a promotion where reasonably necessary, subject to applicable law and any purchases already completed under the applicable promotional terms.

We reserve the right to cancel orders involving fraudulent, unauthorized or abusive use of promotional offers.

11. SALE & CLEARANCE MERCHANDISE

Sale, clearance and promotional merchandise is Final Sale.

This includes merchandise specifically identified as Final Sale and merchandise purchased through designated promotional events or sale categories.

Please review the applicable product and promotional terms before purchasing.

12. STORE CREDIT

Where store credit is approved, it may be issued electronically, including in the form of an eGift card.

Store credit:

• Is not redeemable for cash
• Cannot ordinarily be transferred back to the original payment method
• May be used toward eligible future Sexikinis Swim purchases
• Is subject to any terms disclosed when the credit is issued

Issuing store credit as a customer-service accommodation does not constitute an admission of fault, liability, product defect or misrepresentation.

13. ACCURACY OF ACCOUNT & ORDER INFORMATION

You agree to provide current, complete and accurate information when making purchases or creating an account.

You are responsible for keeping your account information and contact information accurate.

You are also responsible for maintaining the confidentiality of your account credentials.

Please contact us promptly if you believe your account has been accessed without authorization.

14. THIRD-PARTY SERVICES

Our website and mobile application may use or provide access to third-party services, including payment processors, shipping providers, analytics services, marketing platforms and other technology providers.

Sexikinis Swim is not responsible for the independent practices of third-party services.

• Branding
• Product photographs
• Graphics
• Designs

• Videos
• Marketing materials

is owned by or licensed to Sexikinis Swim and is protected by applicable intellectual property laws.

You may not reproduce, copy, distribute, modify, sell, commercially exploit or use Sexikinis Swim content without authorization, except as permitted by applicable law.

16. CUSTOMER REVIEWS & USER CONTENT

If you submit a product review, photograph, testimonial, comment or other content to Sexikinis Swim, you represent that you have the right to submit that material.

You may not submit content that is unlawful, fraudulent, threatening, defamatory, infringing or otherwise violates another person’s rights.

Where permitted by law and subject to any permissions requested from you, we may use customer-submitted content for legitimate business purposes.

17. FRAUDULENT TRANSACTIONS & ABUSE

Sexikinis Swim reserves the right to investigate, refuse or cancel transactions where we reasonably suspect:

• Promotion abuse
• Chargeback abuse
• Account misuse
• Other unlawful activity

We may also restrict accounts or transactions where reasonably necessary to protect our customers or business.

MOBILE TERMS OF SERVICE

19. SMS/TEXT MESSAGE SERVICE

The Sexikinis Swim mobile messaging service (“Mobile Service”) is operated by Sexikinis Swim.

By expressly consenting to receive SMS/text messages, you agree to receive recurring messages from or on behalf of Sexikinis Swim at the mobile number you provide.

Messages may include:

• Order updates
• Account notifications
• Shipping notifications
• Promotional offers
• Sales announcements
• Product launches
• Abandoned cart or checkout reminders
• Other marketing communications

Marketing messages may be sent using automated technology where permitted by applicable law.

Where reasonably practicable or legally required, customers will be notified of material changes affecting their participation.

Our handling of personal information associated with our Mobile Service is governed by our Privacy Policy.

GENERAL TERMS

24. DISCLAIMER & LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Sexikinis Swim is not responsible for indirect or consequential losses arising from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

25. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the extent legally permissible, and the remaining provisions will continue in effect.

Changes will apply prospectively as appropriate and will not remove rights that have already arisen under applicable law.
